Back Pay

Federal employees in government agencies are entitled to bring suit in the Court of Federal Claims under the Back Pay Act when the government has paid less than federal statutes or regulations provide.

Back pay claims include situations in which employees have been affected by “unjustified or unwarranted” personnel actions which resulted in the withdrawal or reduction of all or part of the employees’ pay. The Act also entitles affected parties to reasonable attorney fees related to the action and interest on amounts owed.

  • Represented part-time Veterans Affairs employees in back pay suit to recover Sunday premium pay.
  • Represented Veterans Affairs nurses and physicians’ assistants in back pay case to recover overtime and weekend pay during authorized leave.
  • Represented a variety of landowners negotiating permits and fair market prices for sale or exchange of their environmentally sensitive lands in several western states.
